Is it worth it to sue contractor for bad backsplash job?

I dislike the work a contractor did on tile backsplash. Want to sue. He claims he did what I told him to do but I relied totally on his opinion. Backsplash was tumbled travertine with brown grout. He told me he would bring samples. Didn't want wood like look, even if ceramic. Put large stone pieces 12x24" of travertine by Terra Cara.

I'm so unhappy. Did not explain how to maintain it & I don't think he sealed it. Claimed he could regrout it in 2 hours (I think that's not possible according to an expert grouter).

Is it worth my $$ and time to sue him and what are my chances of winning?
